Salt Lake City, UT (August 22, 2018) — This morning the Utah Supreme Court issued a unanimous opinion against the Utah Highway Patrol and the Utah Department of Public Safety in a civil asset forfeiture case.
That case, Savely v. UHP, deals with nearly half a million dollars taken through civil asset forfeiture and then transferred to the federal government in violation of state laws that prohibit such transfers except in very limited circumstances that were not followed in this case.
To read the opinion and background of the facts of the case, click here.
"The public is rightly outraged by laws that allow the government to take property from people not charged with a crime, as was the case here," said Connor Boyack, president of Libertas Institute. "It's even worse when state laws designed to protect a property owner's rights are not followed by state agencies, which is why we're very pleased to see the state's highest court unanimously holding them accountable."
He continued: "We will be promoting more reforms in the upcoming legislative session that will address what the justices brought up in their opinion, and look forward to helping elected officials better protect the rights of property owners against these civil asset forfeiture cases."
A previous poll on the issue found that 86% of Utah voters oppose current civil asset forfeiture laws.
